Terms and Conditions of Use
Effective Date: November 3, 2026 • Last Revised: November 2026
Please read these Terms and Conditions carefully before utilizing https://waterdamagerestorationdallastx.us or contacting our emergency dispatch line at (972) 945-2394. By accessing our website or requesting service dispatch, you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms and Conditions constitute a legally binding agreement between you ("User," "Client," or "Property Owner") and Water Damage Restoration Experts. By visiting our website, submitting an intake callback form, or calling our emergency hotline, you acknowledge that you have read, understood, and agree to adhere to these terms. If you do not agree, you must immediately discontinue use of this site and its services.
2. Referral & Dispatch Service Model
We connect homeowners, property managers, and commercial building operators with independent, licensed local restoration contractors throughout the Dallas-Fort Worth Metroplex. Service availability, emergency response windows, and contractor credentials depend on the independent dispatch provider. Water Damage Restoration Experts operates solely as a marketing, intake coordination, and referral conduit connecting property owners with independent third-party restoration companies across Dallas County. We do not provide physical water damage remediation, plumbing, demolition, drying, or contracting services directly.
3. Independent Contractor Relationship
All restoration specialists, water mitigation technicians, plumbers, and moisture control crews in our dispatch network are independent business entities and contractors. No employer-employee, agency, partnership, or joint venture relationship exists between Water Damage Restoration Experts and any service provider. Dispatched contractors operate under their own business registrations, maintain independent general liability insurance policies, set their own labor and equipment pricing, and establish their own warranties. Property owners contract directly with the responding contractor.
4. Warranty Disclaimer
This website and our referral dispatch services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied. Water Damage Restoration Experts disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, drying timelines, psychrometric outcomes, or insurance claim approval guarantees. Any warranties regarding workmanship, mold remediation clearance testing, or equipment performance are provided solely by the independent contractor performing on-site services.
5. Limitation of Liability
To the maximum extent permitted under Texas law, in no event shall Water Damage Restoration Experts, its owners, directors, affiliates, or agents be liable for any direct, indirect, punitive, incidental, special, or consequential damages resulting from the use of this website, delay in dispatch, contractor conduct, property damage, mold recurrence, or structural drying disputes. Your sole remedy for dissatisfaction with our dispatch platform is to discontinue use.
6. Life Safety & 911 Emergency Protocol
Water Damage Restoration Experts is an emergency property mitigation dispatch service, not a municipal police, fire, or emergency medical entity. If you observe rising floodwaters posing drowning hazards, active electrical arcing in standing water, natural gas odors, or imminent ceiling and structural collapse, evacuate the premises immediately and dial 911.
7. Property Owner Responsibilities
As a user of our service, you represent and warrant that you are the lawful owner of the property or have full legal authority to grant access to dispatched restoration teams. You agree to provide truthful, accurate service address and contact details, disclose known hazardous materials (such as lead paint or asbestos in pre-1980 buildings), and secure pets and vulnerable occupants prior to technician arrival.
8. Insurance Claims & Direct Billing
Independent contractors in our Dallas network utilize standard insurance estimating software (e.g., Xactimate) and assist with moisture mapping documentation. However, insurance policy coverage, deductibles, endorsements, and claim approvals remain strictly between the property owner and their insurance underwriter. Water Damage Restoration Experts makes no representations regarding insurance claim outcomes.
9. Governing Law & Texas Venue
These Terms and Conditions shall be governed by, construed, and enforced exclusively in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal claim, dispute, or lawsuit arising from these terms or your use of our platform shall be filed and litigated solely in state or federal courts located in Dallas County, Texas.
